The Court case specified:
Barred ALL other business competitors from using a spice blend which contains more the 5 Individual spices in addition to Salt, Pepper, M.S.G. also making Gravy from Crackling, and Cooking with Tarragon and using Tarragon or Tarragon Vinegar from the Coleslaw recipe.
SOME KEY POINTS?
Cooking involves the Heating of a Meal typically. Coleslaw is NOT cooked so the Cooking with Tarragon restricted in cooking in Gravy or Frying Chicken. Also the Court Could NOT bar the use of Vegetables and they were Garden essential's and Spices are NOT essential items. So Celery, Garlic, Onion could NOT be Barred from use.
The Court Did NOT Bar the use of Mixed Spices or Herbs words were INDIVIDUAL SPICES no comment to pre bended spice blend (The Judge could NOT stop the use of Pre-Blended spices or He would have injured companies sales of the Pastry Spice, Pumpkin spice Chili Spice, BBQ Spice ETC he could NOT do that).

So the court case in the 60’s barred all other unrepresented companies from using more than 5 spices except salt and pepper.
Sorry I’m calling you out in that statement. Impossible
Count pats as represented by Glen
Allspice 1 Coriander 2 Ginger 3 Thyme 4 Sage 5 Marjoram 6
I rest my case

I 100% fully doubt it. Seems that it wouldn't stand up upon appeal, sans perhaps for exclusively Lee's Famous Recipe Chicken. KFC has no patent to stand on, and there is nothing sacred or legally binding universally about any number of Herbs and Spices, be it less or more, or the same in count as 11. So I join in calling you out. Every Deep Fried Chicken Restaurant this side of 'perhaps' Lee's (Chain or otherwise) is free to use however many H&S as they choose. deepfriednew101, how many times have you violated the law by using more than 5 H&S?

Lee worked for KFC and he absolutely 100% knew the recipe and Brown and Massey knew that as well. And we have no idea how that split went. Did Lee threaten them in anyway. Did he brag about putting them out of business? Who knows but them. The thing is they watched and targeted Lee for sure. Look how quick the court case came.
There was no need to reveal each others knowledge of the recipe in court. They could prove he knew it.
So far I have found no in court settlement about anyone else being held to the 5. Could they settled out of court. Sure. But read Pat’s settlement. Nothing about 5.
And Karl uses 6 past salt and pepper that he admits to.

Was Lee Cummings (CHS's nephew) the President of CHS's Chicken company before CHS sold it to Brown and Massey?

I have Never Violated any Court Order that Holds water in Canada.
K.F.C. could Only use it as a Pressure Tactic and Out of Court Settlement
Which New Age Did with Marion Kay Bill S.
flg. Ginger is NOT a Herb or Spice classified as a Vegetable like Celery, Garlic, onion

Don't underestimate the power of a court judgment, particularly res judicata. If a court rules on it, it becomes precedent for all similar situations.

True Willie and remember that was 1966 when the Court case took place.
They Did Not Appeal the Court Case and it then stood the Test of Time.
It was used as Presidents for Years in other cases, Then set the standard for using it as a Negotiation Tactic on ALL other Cases where they settled out of court.

In the Lee settlement I was so focused on the 5 ingredients beyond salt, pepper and msg. And how that may or may not have translated to others. I lost sight of what it may tell us. Now I know Deepfried will jump in with he has all the court details etc. But for me it implies that the real OR recipe was likely a minimum of 11 ingredients plus salt, white and black pepper and MSG. So on the low end 15 and could easily be more. Corp wasn’t counting salt, pepper or MSG as part of the 11 or any other number. And it certainly could have been more than 15. If not the case then you are really telling g Lee he can’t use 2 or 3 extra items.
I still think OR is 15+ individual ingredients Any of the Marion Kay variants were 12 total.
