Is there such a thing as "Grandfathering" when it comes to ingredient labeling? No. Yes there is Grandfathering. Look at the Todd Wilbur CMT video and EVERYTIME KFC is asked about how they do not list the spices they say they follow the Original FDA act 1905 they have said it even in 2018 on a interview. NOT the current Law ? ? ? The Processors who had items made and produced Prior to the 1960's have exemption's on the list this is why KFC walks a fine line on what they label. BUT others who manufacture for KFC, the Popcorn chicken and the Wings are regulated different and HAVE to List items as they are NOT using the ORIGINAL SPICES you can write KFC they will tell you they follow the FDA ORIGINAL LAW.

KFC always makes any one who questions Label to quote the 1905 1906 Law as thats what applies to KFC Please comment on why they would do this and if they could NOT they would NEVER allow it to be attached to there CMT video it would have been Illegal for KFC

Many food items are apparently Grandfathered under the umbrella of 'GRAS'. Such foods need to be proven to have been in common use prior to January 1st, 1958.

The published ingredients for KFC_OR do appear oddly different (and lacking intricate details) vs. more recently introduced foods at KFC which are similar, such as Extra Crispy or Chicken Fingers or Popcorn Chicken...

There is indeed also Grandfathering under the DSHEA Act of 1994. Thank you for posting the parts like you are showing Current NEW items KFC creates are under a different umbrella of Label Laws. KFC New Age Corporation has NOT been challenged and they Do Not receive complaints to the FDA if there were active complaints and issues then the FDA have the right to review the Labels and or have KFC adhere to current NEW LAWS. Any out source pre-made pre-processed items like popcorn chicken or wings with new Flavors are under New Laws. If KFC stayed to the Original Spice and Herbs they would only have to list MSG Spice, Herbs, Garlic, Onion. KFC does NOT care if they have to list Salt, or Pepper its a essential item and EVERYONE knows its in the recipe. BUT a VERY important part. IT only has to be listed if it was NOT in the original 11 Herbs and Spices. which they say is protected under the 1905/1906 Law. If the salt and Peppers was in the original 11 Herb and Spices it would NOT have to be listed? CHS always said his First chicken was SALT and Pepper in Flour then he added more Herbs and Spices and he added 11 ELEVEN Spices and Herbs, Seasoning Look at OLD videos the Old ones CHS said Spice and Herbs & Seasoning THEN later it was 11 Herbs and Spices

So back to full circle on this. We know Salt and MSG are not counted in the 11. But is pepper, either white or black, actually counted in the 11? The thing that makes me think possibly no. Is the fact in a couple court cases. The result was they could use Salt and Pepper and MSG plus only 5 H&S. I've asked this before. Is this random or are they saying you can only use half of the H&S ingredients from the OR recipe plus pepper, plus Salt? (garlic is a given, it is printed at list has been for awhile).
Also question for the statements above. If, they are using grandfathering clauses from 1905 laws and saying we still fall under them. Would that imply KFC are willing to say we have never changed any of the 11 ingredients of the OR since 1955. Not once. I'd expect any changes and you would fall outside the grandfathered clause. I guess the only way out would be if way back when you had an agreed upon substitution listing for some of them.

KFC New Age Corporation relies on the 11 Herbs and Spices FROM 1939. That's the Original.
KFC list MSG on all the labels outside the Spices and Herbs.
Salt, Pepper, CHS said were BEFORE the 11 Herbs and Spices and a EXTRA Element was added at the Cumberland Lake 500 Pieces of chicken cooked.
Some people say that 1 of the Vials have Black and White Peppercorns in it ?
KFC New Age Corporation are crafty with there words they Say the Vault contains a Hand Written Note of the Original Recipe, plus Vials containing Spices and Herbs THEY as far as I know HAVE NEVER admitted that the Vials are a 100% True and Accurate representation of the Hand Written Note by CHS.
They always side make reference that there are 2 item's IF SOMEONE has a statement where KFC specifically says the Vials are 100% Accurate to the Handwritten note or similar statement please attach it
They way it has been explained in person to me, the Salt and Pepper, Flour was the first chicken CHS made in a skillet HE then SAID he started adding other Spices, Seasoning Herbs. which he took from Sausage making and also stuffing and combination seasons.
Everyone needs to understand CHS said he was a Prize Bull with a Blue Ribbon shown at a Country Fair for NEW AGE KFC (NA-KFC), and when he did TV and radio for NA-KFC he had to follow a script. Somedays it took two days to make a TV commercial because CHS was so use his own words that did not match the trade marked phrases of 11 Herbs & Spices.
when you listen to the Ministry Interviews where CHS was donating time and off the cuff interviews CHS often went back on his way of speech when he signed 600 Franchises before KFC bought him out.
My learning says this right or wrong with other thoughts but its from CHS and Claudia

Every court case after the Famous Recipe were Bound and Agreed to change the Spices they used
Famous Recipe Marion Kay Grace's Blend Tommy & Cherry Settle
all lost the court cases. They ALL say they Lost the court cases. Bill S & Family did say h they changed the recipe after the court case NOW they just say they have used the same blend since the court case.
Carl from Grace Blend says its different.
Tommy said his recipe was a chicken recipe he knows what goes into chicken recipe and KFC said was a stuffing recipe? Personally I have NEVER seen a Stuffing recipe with 11 Herbs and Spices.
so is it 11 Herbs and Spices or 14/15 items Salt, Peppers, MSG and 11 Herbs and Spice's
I lean more to the OLD Time recipes
Salt and Pepper were always separate
White Pepper was in the 11 Herbs and Spices so my count goes to 14 ITEMS
now in 1939 most recipes Did NOT use powdered Garlic, Onion, Celery, Parsley and Dill it was FRESH
Onion and Garlic in sausage and stuffing were Always Fresh chopped or cut.
if they are outside the recipe its then 16 items
this is my person advise make a small batch of your spices and herbs one with onion and garlic and one without
do your own test

Just so I have it straight. Your thought is.
MSG SALT Black Pepper 1)White Pepper .. 11) Last ingredient = Total of 14 items
Then if Garlic or Onion are used they are counted on top of this so now
15) Garlic Powder or Garlic Salt 16) Onion Powder or Onion Salt
Assuming he used both.
This is very interesting to me as my current thinking of what is in and has been in OR for a good length of time. Line up with this math. I feel I'm close, real close on the ingredient list.
