many Do Not understand Marion Kay lawsuit ended in 1984 after CHS passed away in 1980
BUT the issue with KFC and Marion Kay started in 1969 and in 1973 Marion Kay approached KFC to Make the KFC spice.
In the Court case it was even said that Originally the Marion Kay Spice was indistinguishable from KFC ORIGINAL RECIPE. They stayed away from the issue it was different from what KFC was using in there stores.
CHS had the RIGHT to USE MARION KAY in his stores and Canada, Utah, and England. THAT is why KFC never did anything until after CHS was deceased. NEW AGE KFC Brown/Massey would have lost while CHS was alive ALL he would have had to say is they BROKE the CONTRACT to NOT change the recipe. IT WOULD HAVE BEEN A
open shut court case and CHS would have won another Million Dollars from KFC.
Marion Kay sent seasoning to KFC called Chicken Seasoning or 99X
3. Marion-Kay is an Indiana corporation with its principal place of business at U.S. Highway 50 West, Brownstown, Indiana, and is engaged in the manufacturing of chicken seasoning known variously as "Marion-Kay Seasoning" or "99X Chicken Seasoning."
14. In early 1973, Marion-Kay requested permission to market its seasoning products to KFC franchisees. By letter dated March 15, 1973, Edward E. Ellis, General Counsel for KFC, advised Marion K. Summers ("Summers"), President of Marion-Kay, that KFC would not grant Marion-Kay permission to sell its seasoning to KFC franchisees for use in the preparation of Original Recipe Kentucky Fried Chicken. The letter provides in relevant part as follows:
KFC had Bill S BEAT in court without CHS. KFC won the motion in court and a settlement was agreed between KFC and Marion Kay. Bill S mentioned it in multiple interviews and he said he changed the seasoning.
